Legal Eagles? Empty
PostSubject: Legal Eagles?   Legal Eagles? EmptyMon Oct 03, 2011 10:45 am

Just wondering if anyone has any ideas where I can go with this. Riding on 93N the other day by the Uncle Ho gas tanks. Big shackle & some flotsam flies off of a tractor trailer and crashes up under my bike. Another piece puts a dent in the gas tank. I get the plate number off the trailer, the company name on the trailer, and the name on the tractor. Insurance company says: "Well, it's a Maine plate and it happened here in MA so we can't trace it. Trailer company, and police say there's thousands of those trailers (It's the largest trailer transportation co.) and they're just rented and picked up out of big pools all over the country, and any trailer might be on any truck at any time and there's no way of knowing who had that one! State Police also say "If you're wise, you won't file an accident report, because they'll immediately slap you with a surcharge, no matter what, and you'll have to fight it out at the Registry". Tried to call the company whose name was on the cab...number disconnected. And there's dozens of companies all up and down the Eastern Seaboard with the same name. I know, that's what collision is for, but it's a $500 deductible. And they're clearly responsible. You can bet if it was one of "Their" motorcyclists, they'd have that guy before he hit the NH border.
Where's Flo when you need her?

You have the plate numbers of both the trailer and tractor, I would think that would be enough to locate the company / driver. It sounds like the insurance company and whoever else, is giving you a razzle dazzle answer. The first thing I would do is file an accident report, then if you're not making any progress write to the insurance commissioner. If you get a lawyer involved, it will cost you out of your pocket--nothing gained.

Thanks for reply. I only have the plate number of the trailer. Not the cab. By the time I regained my composure, and felt that the bike was still intact enough to pursue, the guy was a little ahead of me and traffic had filled in. So I had to catch up, and then try to memorize the info. He was diving into the tunnel and I got what I could get quickly, as I was trying to get off and inspect and write the stuff down, while I still remembered it . If you're piloting a Custom Cruiser this stuff doesn't shake you up like it does on a bike, cuz you've got the Photon Torpedo Shields. This morning an appraiser came to look at the bike. He says "For what it's worth, all you're doing is documenting the deterioration of your bike. Now, if you don't fix it, and God forbid, "Something" happens in the future, they'll say 'Well, it was all f'd up anyway' and decrease your settlement."

I've heard of this happening before, seems the only way to move forward is to physically chase down the truck, pull it over & get the police involved.
Sucz being in that position. You couldve been history.
